Summary Judgment Granted In Favor of City of Upland and its Heroic Peace Officers

On August 25, 2016, Judge Virginia Phillips of the Central District of California granted summary judgment in favor of the City of Upland in the matter of Mehta v. City of Upland, et al., Case No. 5:15-cv-01164-VP-DTB.  In this civil rights action, plaintiff filed suit under 42 U.S.C. section 1983, claiming that officers from the Upland Police Department committed acts of “excessive force” during the course of their attempted emergency rescue of the plaintiff from the site of a dangerous car crash involving a fleeing felon. Finding no constitutional violation in light of the officers’ attempt to save plaintiff’s life, the court entered summary judgment in favor of the City of Upland and its peace officers.  Briefing and oral argument handled by Danielle C.
