San Bernardino Court Judge Dismisses Action Against Snowline Joint Unified School District
On May 9, 2016, Judge Bryan Foster of the San Bernardino Superior Court dismissed a negligence and dangerous condition of public property action against the Snowline Joint Unified School District. Specifically, in the case of Astorga v. Snowline Joint Unified Sch. Dist., Case No. CIVDS1402800, plaintiff alleged that he slipped and fell on slippery stadium bleachers during the course of a physical education class. Finding that the plaintiff failed to comply with the jurisdictional requirements of the California Tort Claims Act and waited approximately 2.5-3 years to file a claim for damages, Judge Foster granted the defendant’s motion for summary judgment and dismissed the action in its entirety.
