Kevin J. McNaughton has over 35 years of experience and has successfully tried to verdict a wide variety of bodily injury and property damage jury trials throughout California and a living mesothelioma case in Oregon. Typically the damages sought at trial were in the mid to high seven figure range. The liability claims have involved various negligence, product liability, warranty, premises liability, building contamination, and design, engineering, procurement and construction claims.
Mr. McNaughton has represented a broad array of clients in various sectors including manufacturing, construction, engineering, energy, utilities, governmental entities, ground transportation, heavy equipment, oil field, and insurance industries.
Mr. McNaughton’s primary focus is on the defense of civil litigation, case monitoring and evaluations for excess insurers, early and favorable cost effective resolutions where feasible, and trial of cases as necessary and appropriate. Mr. McNaughton also represents clients before administrative and regulatory agencies (e.g. Cal/OSHA, Mine Safety and Health Administration, Department of Energy, South Coast AQMD, etc.) and provides recommendations to clients with respect to regulatory compliance and litigation avoidance techniques (e.g. Proposition 65, AHERA, lead, mold and asbestos remediation, industry standards and various employment issues.)
Mr. McNaughton is admitted to practice law in the state courts of California and New York and in federal courts in California, New York and Arizona. Mr. McNaughton started his career as an Assistant District Attorney in the Kings County District Attorney’s Office in Brooklyn, New York.
